1. Scope and Acceptance
This Mobile Application End User License Agreement (“EULA”) governs download, installation, access to, and use of Storefront mobile applications, including the Storefront Business Manager and Places applications and related mobile software, features, updates, and documentation provided by Storefront Labs, LLC (“Storefront”).
This EULA supplements the Storefront Terms of Use, Privacy Policy, Acceptable Use Policy, and any applicable Order. By downloading, installing, or using an application, you agree to this EULA.
2. License Grant
Subject to this EULA and the applicable Storefront agreement, Storefront grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the application on compatible devices that you own or control, solely for authorized business purposes. For an application obtained through Apple’s App Store, this license is limited to use on Apple-branded products that you own or control as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including access through Family Sharing, volume purchasing, or Legacy Contacts where permitted.
The application is licensed, not sold. Storefront and its licensors retain all rights not expressly granted.
3. Eligibility and Business Use
The application is intended for businesses and authorized adult users. You must have legal authority to act for the business or organization associated with the account.
You may not use the application for personal, household, consumer, unlawful, or unauthorized purposes.
4. Accounts and Authorized Users
You are responsible for maintaining accurate account information and for all activity conducted through your account, devices, credentials, administrators, employees, contractors, and authorized users.
You must promptly remove access for departed or unauthorized users and protect authentication credentials, tokens, recovery methods, and connected accounts.
5. License Restrictions
You may not:
- copy, modify, distribute, sell, lease, sublicense, or commercially exploit the application except as expressly authorized;
- reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it;
- circumvent access controls, security controls, usage limits, or subscription restrictions;
- use the application to build or improve a competing product;
- remove copyright, trademark, or proprietary notices;
- use the application in violation of the Acceptable Use Policy; or
- permit unauthorized persons to access the application.
6. Device Permissions
The application may request access to device features such as camera, microphone, photos, files, contacts, notifications, Bluetooth, Wi-Fi, location, background activity, motion, NFC, and local storage.
You control many permissions through device settings. Disabling a permission may limit or prevent related functionality.
7. Data and Content
You are responsible for all information, content, instructions, default values, images, audio, video, messages, operating status, hours, and other data entered, uploaded, generated, or transmitted through the application.
Storefront may process this information to provide, secure, support, maintain, and improve the Services in accordance with the applicable agreements and privacy notices.
8. Publishing and Third-Party Platforms
The application may publish, synchronize, or transmit business information to customers, visitors, websites, Google, Apple, and other authorized platforms.
Information you enter, approve, configure, or leave unchanged—including default values—may be displayed publicly or provided to third parties.
You are responsible for verifying that published information is accurate and for reviewing whether requested updates were completed successfully.
9. Location and ETA Features
Where enabled, the application may use device location, routes, traffic information, driving directions, and estimated arrival times to generate operational estimates, including estimated opening times.
Location and ETA information may be delayed, inaccurate, unavailable, or affected by device settings, connectivity, GPS, traffic, mapping providers, or user behavior.
10. Camera, Audio, and Sensor Features
The application may connect to cameras, microphones, signs, sensors, and other peripherals and may store, relay, display, analyze, or transmit photos, video, audio, occupancy, headcount, motion, line length, chair usage, or related information.
You are solely responsible for lawful placement and use, required signage, notices, consent, privacy disclosures, retention, and compliance with recording, surveillance, employee-monitoring, biometric, children’s privacy, and other applicable laws.
11. AI and Automated Features
The application may include AI-assisted recommendations, content generation, automated publication, and workflow automation.
Outputs may be inaccurate, incomplete, delayed, biased, inconsistent, or unsuitable. You must review outputs and maintain human oversight for consequential uses.
12. Messaging
The application may allow businesses to receive and send messages involving customers or visitors. Storefront does not control the content, tone, legality, or safety of messages sent by users or third parties.
Messages may be retained for a reasonable period but are not guaranteed to remain available indefinitely. You should independently preserve messages needed for legal, safety, employment, or business purposes.
13. Updates and Compatibility
Storefront may provide or require updates, patches, feature changes, security changes, or new versions. Updates may add, remove, or modify functionality.
The application may not remain compatible with every device, operating-system version, hardware configuration, network, or third-party service.
Storefront may stop supporting older versions and may require installation of current versions to continue using the Services.
14. Apple and Google App Stores
If downloaded through Apple’s App Store or Google Play, the applicable store terms also apply.
This EULA is between you and Storefront only, not Apple. Storefront, not Apple, is solely responsible for the application and its content. Your use must comply with applicable third-party terms, including your wireless data-service agreement.
Storefront is solely responsible for maintenance and support of the application. Apple has no obligation to provide maintenance or support.
If an application obtained through Apple’s App Store fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the application. To the maximum extent permitted by law, Apple has no other warranty obligation, and Storefront is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty.
Storefront, not Apple, is responsible for addressing claims relating to the application or your possession or use of it, including product-liability claims, claims that the application fails to comply with applicable legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar law.
If a third party claims that the application or your possession or use of it infringes that party’s intellectual-property rights, Storefront, not Apple, is solely responsible for investigating, defending, settling, and discharging the claim.
You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on any U.S. Government prohibited- or restricted-party list.
Apple and its subsidiaries are third-party beneficiaries of this EULA for applications distributed through Apple’s App Store. Upon your acceptance of this EULA, Apple has the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
15. Security
You must use reasonable security practices, including strong credentials, supported devices, operating-system updates, screen locks, secure networks, and prompt reporting of suspected compromise.
Storefront may suspend or restrict application access to protect accounts, systems, customers, users, or third parties.
16. Fees and In-App Purchases
Subscriptions, usage fees, hardware charges, and other purchases are governed by the applicable Order and Storefront Terms of Use.
Purchases processed through an app store may also be governed by the store’s payment, refund, and subscription rules.
Unless required by law or expressly stated otherwise, fees are non-refundable.
17. Termination
This license ends when your Storefront account, subscription, or right to use the Services ends or when you breach this EULA.
Upon termination, you must stop using and delete the application, although certain data and obligations may survive in accordance with the applicable agreements and law.
18. Disclaimers
The application is provided “as is” and “as available.” To the fullest extent permitted by law, Storefront disclaims all express, implied, statutory, and other warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, compatibility, and uninterrupted operation.
19. Limitation of Liability
Liability arising from the application is subject to the limitations, exclusions, claims period, indemnification, arbitration, and other risk allocations in the Storefront Terms of Use.
To the fullest extent permitted by law, Storefront is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost data, recordings, profits, business, goodwill, or opportunity; or third-party platform, device, connectivity, or integration failures.
